    What happens when a company starts to explore selling an invention before a U.S. patent application has been filed? That was the question before the Court of Appeals for the Federal Circuit (CAFC) in the recent case of Group One v. Hallmark. The court rejected Hallmark's "on-sale" defense and held that Group One's patents were not invalid for violating the grace period. It thus sent the case back to the district court for a full trial of Group One's charge of infringement.

  • Feedback Credibility Issues In Trust Management Systems

    E-commerce, despite its many advantages, is still not living up to its full potential. To mitigate this problem, several trust management systems in the form of online ratings have been developed. The basic idea is that the system maintains reputation or trust-level of the buyers and sellers, and makes them available to other interested parties to make decisions to engage in a transaction. One of the reasons is the lack of trust that users have in Internet-enabled exchange of goods. The quality of the reputation value depends on the quality of the feedback provided by transacting partners. However, feedback is susceptible to various threats that render the trust management systems untrustworthy. This paper examines the vulnerabilities of feedback-related issues of trust management systems and suggests a mechanism to mitigate these threats.

  • FACTS: an approach to unearth legacy contracts

    The large number of contracts in force in an enterprise becomes an important factor in making business decisions. Moreover, an enterprise must be able to respond to events that might affect existing contractual relationships. However, most enterprises do not have the capability to easily manage the life cycle of enterprise contracts. Current solutions bundled into products are typically only efficiently used when applied to new business contracts but not to legacy ones, which often constitute the majority of the contracts in an enterprise. Critical information in such contracts remains buried in the text of these documents, requiring a tedious and costly manual inspection task to extract the information required for their proper management. In this paper we present an approach, called FACTS, to automatically elicit legacy contracts information that enables the effective and efficient management of their lifecycle. The approach is based in the use of two object models in conjunction with information extraction techniques. Once relevant information in a contract is identified, it can either be automatically tagged with XML or simply extracted into a contract facts database. In both cases, relevant contract information becomes readily available through predefined or ad-hoc queries.

  • Research on the Collusion Problem for MMOG

    This paper puts forward a kind of detecting method of collusion suitable for MMOG. Through the analysis of the collusion behavior by sociology, it is known that participates in collusion exist abnormal behavior and abnormal relations between earning and losses. Firstly, the behavior patterns library is established for the players, and it is applied to detect their abnormal behavior. Simultaneously, the players'relations between earning and losses are described by statistics to detect the abnomal relation. At last ,the probability of collusion among abnomal players is calculated by theory of evidence. The experiment results show that this method can accurately detect collusion, and collusion behavior would been restrained.

  • How hypermedia technology can help learning the law of international commercial transactions

    The authors share their experience and ideas about what multimedia and hypermedia technology can bring to law students, in particular about learning contractual techniques. More specifically, they present the way these techniques are used and will be used in developing a databank on international contractual clauses for training students in the law of international commercial transactions and in contractual techniques.

  • Infusing an Architectural Framework with Neo-Institutional Theory: Reports from Recent Change Management Initiatives within the Swedish Public Administration

    Swedish public administration is currently undergoing radical change towards dynamic models of governance relying on a high level of inter-governmental collaboration. This high level of interoperability between governmental organizations and the subsequent quality of service for citizens and companies depending on the services provided by government is summarized in the vision- statement of the 24-hour government (24-timmarsmyndigheten). According to the primary actor&#145;s (Statskontoret) recommendation, this vision is to be realized through the application of web-service based technology, resulting in a Service Oriented Architecture (SOA). The purpose of this paper is to investigate a possible infusion of a previously developed architectural framework for change management with neo-institutional theory. The results show that neo-institutional theory could be used to infuse the architectural framework with aspects regarding primarily history and legitimacy, but also with an overall contradictory perception of change. Given the vast differences in fundamental assumptions underlying the architectural framework and neo- institutional theory, the paper concludes that these results are however somewhat problematic.

  • A study on the factors influencing license income of technology commercialization in United States Universities

    Although high-tech industries and academics have the capability of research and development for technologies, the capability of technology commercialization is considered to be more important. If they only do R&amp;D without commercialization, it might lead to no returns. Due to the spur of US governmental policies, research-oriented purposes in universities are switched to industrial purposes instead of science purposes. After the Bayh-Dole Act was enacted in 1980, the activities of technology transfer between academics and industries dramatically boosted. The factors, which influence the performances of technology transfer, were proposed by some pervious researches, and most of them suggested that researches expenditure, patents, and published articles carry significant weight. According to some case studies of famous journal, they pointed out that patents have no contribution. This study uses AUTM licensing survey to figure out the relationship between issued patents, published articles, and technology commercialization. The result of the study shows that published articles do have an effect, but issued patents do not make a significant effect on technology commercialization.
